Web Design and Development Policies and Terms of Service

Privacy:

- The client is responsible for providing accurate and reliable contact information. The client agrees that any email address given for business purposes will be active and understands that the client is responsible for replying to all correspondence sent to that address by Zeronese, Inc. Failure to respond in a timely manner may result in a suspension of your account if Zeronese, Inc. is unable to contact you for a 14 day period using the contact information that you have provided.
- Information terms of use: All information collected from a client by Zeronese, Inc. for the purpose of a web design project is used for that purpose only. Your information will not be sold, rented or otherwise distributed for any purpose.
- Financial information is gathered through secured forms on our site for the purpose of collecting payment for projects and is never released to any other person or organization.

Limitation of Liability:

Zeronese, Inc .will not be liable for indirect, special or consequential damages, or any loss of revenue or profits, arising in connection with the projects that we developed. Zeronese, Inc. is not responsible for hosting company / internet service provider / domain name registrar / or other outside agencies issues, damage, downtime, email problems, website hacks and other security issues or any part thereof. 

Fees and Payments:

- Zeronese, Inc. charges on a per project basis. A designer will work with you to discuss and understand your requirements and then give you a price quote for your project. The only times we work on an hourly rate are: Post-delivery website maintenance and update services. In this scenario, we bill at $50 per hour with a minimum charge of half an hour.

- Fees to Zeronese, Inc. are due before the commencement of any contracted work. If payment is not arranged within 7 days of the Submission of the Order Form, the account can be cancelled by Zeronese, Inc. The entire amount of the contract becomes due and payable at the time that the work is contracted - NOT upon completion.
- Projects under $1000 must be paid upfront in full.

- A 50% deposit is required for projects over $1000. A payment plan will be provided to you according to the progress timeline plan for the remaining balance.

Quotes & Contracts:

Quotes provided to prospects will be honored for 30 days. A new quote will then be provided upon request.

Refunds, Modifications and Cancellation:

We will work with our client requesting a web design and/or a web development project to thoroughly and fully understand and agree on the requirements. Once a mutual agreement is established we will give you a price quote based on this agreement. Based on this, No refunds will be issued after payment. Your payment is considered as an agreement for what is to be done for you. Any changes and/or modifications  request by you after agreed completion and upload may be subject to additional charges. Additional work requested will be considered as a separate work order. A new price quote will be given to you after discussion for any new modifications that will be done and are not mentioned in the original agreed paid for project. You must submit a new order form when adding additional pages/features to your web site. Any further revisions in your web site may result in additional charges if it requests anything other than a simple change of contact information or a correction of an error. A project in progress can not be cancelled once started. All paid balances are not refundable in any case.

Time Frame:

We will provide you with an estimated time of delivery for your project. However, we do not guarantee deadlines as each project is unique and so is each customer. We will communicate with you during the entire development of your project and provide you with status updates. Please understand that additional services, revisions to design or development of your site and delays in providing us with the information we require will significantly add to the delivery time. Zeronese, Inc. and the client must work together to complete the web site in a timely manner. Zeronese, Inc. agrees to complete the web sites in a timely manner, no later than a time frame given to you when the project is agreed upon from the time that ALL information and materials are received by Zeronese, Inc. Any time frame agreed upon for a project should be viewed as a mutual objective. We will do our best to meet the time frame we provide. On certain circumstances that are out of our hand, a slight delay might happen, you will be informed immediately about the delay and the reason. Any time frame agreed upon for a project should be viewed as a mutual objective. If a client has agreed to provide textual content and photos in an effort to reduce labor costs, Zeronese, Inc. will need such materials within the agreed project timeline in order to complete the project. Client acknowledges and agrees that Zeronese, Inc. cannot guarantee the absence of service interruptions caused by Acts of God or other circumstances beyond their control including, but not limited to, local telecommunications problems, line failures, or temporary down time for maintenance or upgrades. The client also accepts that because web pages rely on delivery through a world-wide web of co-operating systems - from time to time, any web site may temporarily experience interruptions beyond the control of Zeronese, Inc.
 

Copyrights and Trademarks:
 

The client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Zeronese, Inc. for inclusion in the web site are owned, or that the proper permissions were received by the client from the rightful owner to use these elements in the web site. The client further guarantees that Zeronese, Inc. will be held harmless, be protected from, and be defended from any claim or suit arising from the use of such elements furnished by the client.

Refusal of Service:
 

Zeronese, Inc. reserves the right to refuse service for any web site or material that that it feels is not legal, moral, or in the best interests of Zeronese, Inc. furthermore, Zeronese, Inc. is not responsible for the content of any web site. zeronese, Inc. may cancel this contract for failure of the client to abide by its terms.

Our Guarantee to You:

Zeronese, Inc. guarantees to you that every website and ecommerce store we develop will be fully operational and working as per the requirements upon delivery. If your site or ecommerce programming has been edited by anyone other than an employee of Zeronese, Inc. this guarantee is then voided, and charges for editing the site will be applied at our hourly rate. We will always advise you of and seek permission for changes to your website and the charges that will be applied before any work is completed.
 

Web Template Modefications:

If your project is a website template modification, the use of template graphics and design is still governed by Zeronese, Inc Website Templates Terms and Policies.

Acceptance:

Please note that by submitting your down payment for services you are agreeing to all of our terms of service as written here. Zeronese, Inc. reserves the right to change or update these terms at any time without notice.


These terms of service are for the good of both the client and Zeronese.net. We have set these guidelines in place to help avoid unproductive scenarios that waste time and money for both parties. We have numerous references we can provide to a prospective customer, as our list of happy clients grows larger each day!
